Chapter 13 - The Mountain House Seizure

At two o'clock that afternoon, the winter sun broke through the gray clouds over the Blue Ridge Mountains, casting long, pale shadows across the ridges of Henderson County[cite: 21].

The driveway of 412 Ridgecrest Drive in Hendersonville was paved in dark slate, winding through five acres of pristine mountain laurel and towering hemlocks[cite: 21].

The house was a six-thousand-square-foot timber-and-stone lodge featuring vaulted ceilings, floor-to-ceiling glass looking out over the mountain peaks, and an outdoor stone fireplace[cite: 21].

Parked on the circular driveway were two commercial moving vans, their ramps down onto the stone[cite: 21].

Four men in canvas work coats were carrying leather sofas and designer rugs out through the double front doors[cite: 21].

Standing by the tailgate of the lead van, directing the movers with frantic, sweeping gestures, was Renee Hayes[cite: 21].

She had discarded her St. John knit suit for a padded down jacket, her hair disheveled by the mountain wind, her voice shrill with desperate urgency[cite: 21].

"Load the antique armoire first!" Renee screamed at the driver[cite: 21]. "We have to be on the highway toward Atlanta before three o'clock!"[cite: 21]

Beside her, leaning heavily on a brass-handled cane, stood Robert Hayes[cite: 21].

His face was mottled gray, his expensive camel-hair coat unbuttoned, his hand shaking violently as he dialed his legal team in Atlanta on a cell phone that kept dropping signal[cite: 21].

A white-and-gold cruiser from the Henderson County Sheriff's Department pulled smoothly into the driveway, blocking the exit lane[cite: 21].

Behind it came Arthur Vance's black sedan[cite: 21].

Deputy Sheriff Miller and two state marshals stepped out of the cruiser, accompanied by Arthur Vance and me[cite: 21].

When Renee saw me step onto the slate driveway, she let out an animalistic shriek, dropping her clipboard onto the stone[cite: 21].

"You!" Renee screamed, lunging forward three steps before Deputy Miller caught her by the arm[cite: 21]. "You vengeful, miserable old woman! How dare you follow us up here!"[cite: 21]

"Mrs. Hayes, step away from the commercial vehicle," Deputy Miller commanded, holding out an unsealed judicial seizure writ stamped with the red seal of the North Carolina Superior Court[cite: 21].

"I am executing an immediate writ of attachment and physical sequestration on this parcel pursuant to an emergency order entered in Charlotte at noon today[cite: 21]."

Robert Hayes staggered forward, his cane clicking against the slate[cite: 21].

"Officer, this property was purchased by an independent Georgia trust!" Robert yelled, his voice cracking with rage[cite: 21]. "We hold unencumbered title! You cannot seize a private residence without an evidentiary hearing!"[cite: 21]

Arthur Vance stepped forward, opening his leather portfolio[cite: 21].

"The Georgia trust was declared a fraudulent sham entity three hours ago by the United States District Court in Greensboro, Mr. Hayes," Arthur stated, his voice ringing with cold, absolute authority[cite: 21].

"Your son-in-law, Derek Overstreet, has executed a full, sworn confession admitting that the four hundred thousand dollars used to purchase this home was embezzled from the Overstreet Family Trust[cite: 21]."

Robert Hayes stopped dead[cite: 21].

His eyes bulged, the color vanishing from his lips as his cane slipped from his fingers, clattering loudly against the driveway[cite: 21].

"Derek... confessed?" Robert whispered in sheer, paralyzed horror[cite: 21].

"He surrendered the bank tokens, the wire instructions, and the recorded phone calls where you instructed him to forge his mother’s death certificate, Robert," I said, walking up the steps until I was looking down into his ruined face[cite: 21].

Renee let out a wild, choked sob, grabbing her husband's coat[cite: 21].

"Robert! Do something! Tell them it's a lie!"[cite: 21]

"It isn't a lie, Renee," I told her, my voice quiet and immovable as the granite mountains behind them[cite: 21].

"This house is being transferred into a court-supervised receivership[cite: 21]. The movers will unload your personal clothing into your car, and the remaining assets will be liquidated at public auction on Monday morning to reimburse my husband's estate[cite: 21]."

The two state marshals stepped past them into the house, placing yellow official evidence seals across the double front doors[cite: 21].

The moving truck driver immediately pulled his ramp up, climbed into his cab, and shut the engine off, refusing to move another piece of furniture[cite: 21].

Renee collapsed onto the stone retaining wall, burying her face in her hands, weeping with the raw, humiliating realization that forty years of high-society posturing had ended in a mountain driveway with two state marshals locking the doors[cite: 21].

Robert Hayes stood in the freezing wind, his head bowed, unable to meet the eyes of the woman he had tried to bury in an unrecorded grave[cite: 21].

"Take your wife and your luggage, Robert," I said softly[cite: 21]. "And leave Leonard's mountain[cite: 21]."

Arthur and I climbed back into the sedan, leaving the two of them standing in the falling shadows of the Blue Ridge, completely stripped of the wealth they had tried to steal[cite: 21].
