Chapter 5 - The Bail Hearing from Hell

The main courtroom of the New York State Supreme Court was packed to capacity.
The air was heavy with anticipation, reporters furiously tapping on their laptops in the gallery while armed court officers lined the oak-paneled walls. At the defense table sat Richard Whitmore, flanked by a court-appointed public defender who looked entirely out of his depth.
Richard was a shell of the man who had strutted through our ballroom twenty-four hours earlier.
His Tom Ford suit was crumpled and stained, his hair wild, his eyes hollow and bloodshot. His hands were bound by heavy iron cuffs attached to a chain around his waist. Every time someone in the gallery whispered, his head jerked up frantically, searching for an ally, a friendly face, someone who could rescue him from the nightmare.
He saw no one.
The side doors opened, and the gallery fell dead silent.
I walked into the courtroom.
I walked with my head held high, flanked by Ethan and Alexander. Nathaniel broke away from our group and walked straight past the bar, taking his seat at the prosecution's table as Special Assistant State Attorney—a distinction granted to him hours earlier by the State Governor himself.
Richard’s eyes locked onto mine. His mouth fell open, his chest heaving. "Catherine..." he croaked, his voice raw. "Catherine, please! Tell them! Tell them it was a mistake!"
"Silence at the defense table!" the bailiff barked, slamming his hand against the railing.
"All rise!"
Judge Margaret Henderson, a woman known for her ironclad demeanor and zero tolerance for violent offenders, swept into the room and took her seat beneath the state seal. She adjusted her glasses, looking down at the paperwork with an expression of profound disgust.
"Case number 4492, the State of New York versus Richard Whitmore," the clerk announced. "Charges: Aggravated First-Degree Assault, Felony Domestic Battery with a Deadly Weapon, Unlawful Imprisonment, Witness Intimidation, and Grand Larceny."
Judge Henderson looked down at the defense table. "Mr. Whitmore, I understand your private counsel withdrew this morning."
Richard struggled to stand, the heavy chains rattling against his waist. "Your Honor! I have been denied my rights! My accounts have been illegally frozen! I am the CEO of a multi-million-dollar enterprise! This entire circus is a smear campaign orchestrated by my mentally unstable wife to steal my assets!"
Judge Henderson didn't blink. She turned her cold gaze toward Nathaniel Sterling. "Mr. Sterling, does the prosecution have a response regarding bail?"
Nathaniel stood, tall and imposing, buttoning his tailored jacket.
"Your Honor, the State moves for the complete denial of bail. The defendant represents an extreme flight risk and an immediate, lethal danger to society and the victim."
Nathaniel stepped toward the bench, presenting a leather-bound file.
"We submit into evidence the forensic medical report from St. Jude’s Hospital. The victim, Catherine Sterling Whitmore, sustained thirty deep lacerations from a braided leather riding crop, resulting in severe tissue damage, extensive hemorrhaging, and spinal contusions. Furthermore, we submit the verified video recording from the cellar of the Whitmore residence."
"That video was doctored!" Richard screamed, throwing himself against the defense table. His public defender frantically pulled at his sleeve, begging him to shut up. "She fabricated it! She’s trying to destroy me! Look at her! She’s fine! She’s sitting right there looking like royalty!"
Judge Henderson slammed her gavel down with a crack that sounded like a gunshot.
"Mr. Whitmore! One more outburst from you, and I will have you gagged and bound for the remainder of this proceeding!"
Richard choked on his own breath, sinking back into his chair, his chest shuddering.
"I have personally reviewed the video evidence," Judge Henderson said, her voice dripping with venom. "In my thirty years on the bench, I have rarely witnessed an act of such calculated, sadistic depravity. You trapped a defenseless woman in a subterranean vault, assaulted her repeatedly, and left her to bleed while you went upstairs to eat cake with your mistress."
The judge turned a page in her file.
"Furthermore, the court has received notification from the Securities and Exchange Commission and the Department of Justice. A federal grand jury has returned a six-count indictment against Mr. Whitmore for wire fraud, corporate embezzlement, and the theft of forty-eight million dollars from the Whitmore Enterprises employee retirement fund."
Richard’s eyes bugged out. "What?! No! That’s Vanessa! Vanessa did that! She tricked me! She had the offshore accounts!"
"Miss Vanessa Cross was arrested at JFK International Airport at six this morning," Nathaniel said calmly, turning slightly so the entire courtroom could hear him. "She has signed a full confession and an evidentiary proffer detailing how Richard Whitmore instructed her to transfer those funds in anticipation of fleeing the country."
A collective murmur erupted in the gallery. Reporters were furiously typing, flashbulbs popping outside the glass doors.
"Your Honor!" Richard wailed, tears of self-pity finally streaming down his stubbled cheeks. "Please! I have nowhere to go! My company... my assets..."
"You have no company, Mr. Whitmore," Nathaniel added smoothly. "At eight o'clock this morning, the Board of Directors of Whitmore Enterprises unanimously terminated your employment. Under the corporate governance bylaws, seventy-two percent of voting shares have been legally transferred to the primary creditor, Sterling Maritime Holdings, represented by Mrs. Catherine Sterling."
Richard turned his head toward me, his face twisted in horror and incomprehension.
"Catherine... no... you can't do this... Lily... think of Lily!"
I stood up from the gallery bench.
I didn't yell. I didn't cry. I looked down at him with the cold, unyielding majesty of a queen passing sentence on a traitor.
"Lily is safe, Richard," I said, my voice echoing clearly through the courtroom. "She has a family that loves her. A family with the power to protect her from monsters like you. You will never see her again."
Judge Henderson struck her gavel once more.
"Bail is denied. The defendant will be remanded to the custody of the Department of Corrections at Rikers Island pending trial. Next case."

Two armed officers grabbed Richard by the shoulders, lifting him off his feet as he screamed, kicking and thrashing against his chains, his cries echoing down the marble halls until the heavy steel doors slammed shut behind him.
