Chapter 5 - THE LEGAL WAR BEGINS

By 9:00 AM on Monday morning, the legal wheels had begun to turn with terrifying speed.

I sat in the high-rise office of my family law attorney, Marcus Vance, in downtown Columbus. Marcus was a seasoned, sharp-eyed attorney who specialized in high-conflict paternity and custody disputes.

On the glass conference table sat the twins' certified birth records, my post-divorce medical timeline, and the written invitation Mark had sent me with his handwritten insult at the bottom.

"Claire," Marcus said, reviewing the invitation through his silver-rimmed glasses. "This handwritten note from Mark is pure gold for our case. It proves premeditated malice. He invited you to a public event specifically to inflict emotional distress, completely unaware that he was walking into a biological reality."

"What are our options, Marcus?" I asked, sipping my coffee.

"Mark’s legal team filed an emergency motion for a court-mandated DNA paternity test two hours ago," Marcus revealed, sliding a legal brief toward me. "They are attempting to claim that you intentionally alienated him from his paternal rights to extort child support."

I scoffed. "He abandoned me! He told me I was broken!"

"And we have seven years of fertility clinic records to prove that he actively blamed you for unexplained infertility," Marcus pointed out smoothly. "When the DNA test confirms he is the father—which we know it will—the court will view his historical behavior as severe paternal neglect."

"What about back child support?"

"Under Ohio law, because you were not married when the children were born and he was not listed on the birth certificates, back support can be retroactively awarded for up to three years," Marcus explained. "Based on Mark's verified corporate income of $220,000 a year, he is facing an immediate lump-sum arrearage judgment of approximately $95,000, plus monthly support payments of $3,800."

I took a deep breath. I didn't care about the money for myself, but that capital would secure Luke and Owen’s college funds forever.

"What about custody?" I asked, my voice tightening. "Can he take my boys away from me?"

Marcus smiled reassuringly. "Not a chance, Claire. He is a total stranger to two three-year-old children. The court will never grant overnight custody to a man who called his children names in public and hasn't spent a single day raising them. If he gets any visitation at all, it will be strictly supervised at a court-appointed family center for one hour a week."

My phone buzzed on the table. It was a text message from an unknown number.

I opened it.

It was a message from Emily, Mark's new pregnant wife:

“Claire, this is Emily. I am sitting in my lawyer's office in Columbus. I need to talk to you privately. Please. Without Mark or his mother knowing.”

I looked up at Marcus, holding out the phone.

"She wants to talk," I said.

Marcus grinned dryly. "Take the meeting, Claire. The new wife is about to become your greatest ally."
